Contra Costa Times runs PLF op-ed targeting “Plan Bay Area”

SACRAMENTO, CA;  September 13, 2013: Pacific Legal Foundation recently filed a lawsuit challenging Plan Bay Area, a restrictive land use blueprint for the nine-county San Francisco Bay Area.  PLF represents a grass roots coalition of residents from throughout the region, called Bay Area Citizens.

Now, the Contra Costa Times has highlighted PLF’s case by publishing an opinion piece by PLF Staff Attorney Jonathan Wood, titled “Plan Bay Area drafters buried critical facts.”  Read the op-ed.

Plan Bay Area would squeeze up to 78 percent of new housing and 62 percent of new jobs into just five percent of the region’s surface area over the next two decades.  Drafters claim this draconian “stack and pack” mandate is needed to meet state targets for greenhouse gas reduction in the Bay Area.

As Wood’s op-ed points out, this claim is false.  He notes that the targets will be reached whether or not Plan Bay Area takes effect, because of “new state mandates for cleaner gasoline and for improved automobile mileage and emissions.”  By failing to adequately disclose this fact, Plan Bay Area’s drafters violated government transparency requirements in the California Environmental Quality Act (CEQA).

Wood holds a J.D. from New York University School of Law, and is a fellow with PLF’s College of Public Interest Law (CPIL), a litigation training program for promising recent law graduates.

Filed in Alameda County Superior Court, the case is Bay Area Citizens v. ABAG and MTC.  The petition for writ of mandate, a video, and a podcast.
