San Francisco says “stick em up” to landlords who want out of rental business

Daniel and Maria Levin v. City and County of San Francisco

Contact: J. David Breemer

Status: The Levins have filed a Motion to Dismiss the Appeal on June 8, 2015. The District Court denied Defendant's motion for relief from Judgment on July 23, 2015. Oral argument before the 9th Circuit held on February 11th 2017.

Summary:

Levin - 4-1528PLF is challenging San Francisco’s new “Relocation Assistance Payment Ordinance,” because it requires rental property owners to pay their tenants oppressive and unconstitutional sums of money before the owners can regain personal use of their property — money the tenants can use for any private purpose they wish.

PLF attorneys filed the challenge on behalf of homeowners Daniel and Maria Levin, a married couple who own a small two-unit house on Lombard Street.  They live in the upper unit, but are effectively denied the right to take occupancy of the lower unit, because of the costly payment — $117,000, in their case — required by the new ordinance.

PLF attorneys also represent two associations of residential rental property owners — the San Francisco Apartment Association and the Coalition for Better Housing — and Parklane Associates, owner of an apartment building subject to the ordinance.

PLF Testimonial

"Individuals for whom a major case is a one shot deal are far more aggrieved. Most individuals cannot afford to do anything with that grievance, and that's where organizations like PLF come in."
