However the election goes, PLF’s Obamacare challenge goes on!
We’ve actually heard from folks who wonder if PLF’s constitutional lawsuit against Obamacare could be dropped, depending on who wins the elections next week.
Our answer: No way, no how!
Whatever the results on November 6 — even if opponents of Obamacare come out on top — there is no guarantee that its costly, intrusive, unconstitutional provisions will be repealed.

So our job continues. PLF is a pro-freedom legal watchdog — not a political organization. With the support of liberty-loving donors nationwide, PLF defends the Constitution in court, no matter who holds office in Congress, the state houses, or the White House.
Obamacare, with its massive, illegally enacted tax hikes, violates the Constitution. That’s why PLF is in this fight — and that’s why we’re staying in this fight!
If Obamacare is repealed by lawmakers or the Executive Branch, we will be glad to withdraw our lawsuit and join in the celebrations. But until that day — no way are we going away!
Tax-raising Obamacare started unconstitutionally — on the wrong side of the Capitol building
The Supreme Court labeled Obamacare’s financial charge for not buying health insurance as a “tax.”
PLF’s lawsuit says this means Obamacare is procedurally unconstitutional — because it didn’t start in the House of Representatives, as tax bills are required to do.
The Constitution’s Origination Clause (Article I, Section 7), says new revenue-raising measures must begin in the lower House — a safeguard for liberty by vesting the power to initiate taxes with the lawmakers who are closest and most accountable to the people.
But Obamacare started in the Senate, as a proposal by Senate Majority Leader Harry Reid.
Writing about PLF’s lawsuit, Georgetown University Law School Professor Randy Barnett said, “If any act violates the Origination Clause, it would seem to be [Obamacare].”
