Challenging Florida’s unjustified restrictions on craft brewers

Status: Complaint filed in the U.S. District Court for the Southern District of Florida on October 28, 2014. On Jan. 15, 2015, the Court denied Defendants' motion to dismiss. The case was voluntarily dismissed on May 21, 2015.
 
Summary:
Craft brewers typically sell their beer via 64-ounce growlers, which many patrons collect and then re-use to purchase beer at other brewers.  In Florida, however, a state packaging law prohibits the sale or re-filling of these growlers by anyone involved in the alcohol industry.  PLF attorneys are challenging this restriction as an unconstitutional denial of equal protection and due process, because there is no rational basis for it.
